Effective Date: 1st July, 2025

By enrolling in the tutoring services provided by Expert Tutoring (“we,” “us,” or “our”), you (“Parent/
Guardian,” “Client,” or “you”) agree to the following Terms and Conditions.

1. Session Attendance and Punctuality
1.1 The Student shall attend all scheduled tutoring sessions (“Sessions”) at the agreed date and time.
1.2 The Student must be punctual and prepared with necessary materials, including textbooks,
stationery, and applicable tools (e.g., scientific calculator).
1.3 Sessions will end at the scheduled time. No additional time will be provided for lateness or lack of preparedness.
1.4 A quiet, safe, and appropriate environment must be provided for sessions.
1.5 For online sessions, a parent or legal guardian must be present in the home. Cameras and
microphones must remain operational.
1.6 Mobile phones or other distracting devices are strictly prohibited during sessions.

2. Cancellations, Rescheduling, and Absences
2.1 Clients may cancel or reschedule a session provide that a minimum of 8 hours’ notice is given prior to the scheduled Session start time.
2.2 Cancellations with less than 8 hours’ notice will incur 100% of the session fee.
2.3 Cancellations made with more than 8 hours’ notice can be rescheduled subject to availability or will incur a 50% cancellation fee.
2.4 No-shows or cancellations made via email, text, or other methods will not be accepted and will be charged in full.
2.5 Sessions missed due to verified illness, school camps, or excursions may be rescheduled at Expert Tutoring's discretion, provided notice is given.
2.6 If a Tutor is unavailable, we will make reasonable efforts to reschedule or assign a replacement.

3. Fees and Payment
3.1 Invoices shall be issued following each Session unless otherwise agreed, and payment shall be due within three (3) days of invoice issuance.
3.2 Accepted payment methods include:

• Bank transfer (with Student name and invoice number referenced);

• Credit card via Stripe (a processing fee applies);

• Prepaid packages via TutorCruncher.

3.3 If payment is not received within 3 days, an automated reminder shall be issued. A late fee of ten
dollars ($10.00) shall apply to any invoice unpaid after the reminder.
3.5 Expert Tutoring reserves the right to suspend or terminate Services if payment obligations are not met, and to reallocate the Student’s time slot to another Client.
3.6 No refunds will be issued for unused prepaid sessions due to early termination by the Client.

4. Term Commitment and Early Termination
4.1 Enrolment in the Tutoring Program is deemed to constitute a commitment for the full duration of the school term.
4.2 If the Client elects to withdraw the Student prior to the conclusion of the term, fifty percent (50%) of the fees for the remaining Sessions shall become immediately payable and due within seven (7) days.
4.3 Confirmation of continuation for subsequent terms must be communicated by the final week of the current term to retain priority placement.
4.4 Either party may terminate Services by providing reasonable notice if it is determined that the
continuation of Services is no longer beneficial.

5. Scope of Services and Academic Expectations
5.1 Tutors will provide instruction aligned with the Australian Curriculum and tailored to support the
Student’s individual learning objectives.
5.2 Tutors shall not, under any circumstances, complete or contribute to homework, assignments, or assessment tasks that are required to be the Student’s own work.
5.3 While Expert Tutoring endeavours to support academic improvement, no warranties or guarantees are made with respect to specific academic outcomes. The Client expressly waives all claims related to the Student’s academic performance.

6. Client and Student Responsibilities
6.1 The Student shall join Sessions on time and be adequately prepared for all Sessions.
6.2 The Client shall ensure a suitable physical environment is provided and that required technology (including internet, webcam, microphone, and browser) is functional.
6.3 The Student must not engage in behaviour that is disruptive, disrespectful, or inappropriate. Tutors may decline to teach Students who display unacceptable conduct.

7. Tutor Responsibilities
7.1 Tutors must:

• Commence and complete each Session in a punctual and professional manner;

• Notify Expert Tutoring of any required absences at the earliest opportunity (minimum 24 hours’ notice

• preferred);

• Remain available for twenty (20) minutes following the scheduled Session start time in cases of Student no-shows.

7.2 In cases of Tutor delay or technical difficulty, lost time shall be made up during the Session or at
another mutually agreed time.
7.3 Tutors shall not enter into any private arrangements with Clients introduced through Expert Tutoring.
Any breach shall result in the forfeiture of all fees and earnings to Expert Tutoring.

8. Privacy and Confidentiality
8.1 All personal information, academic records, and communications shall be handled in accordance with applicable privacy laws and treated as confidential.
8.2 Information shall only be disclosed where required by law or with the Client’s written consent.
8.3 Clients may request the deletion of personal data, which may result in the suspension or termination of Services.

9. Online Tutoring and Technical Requirements
9.1 Clients must ensure the Student has access to a device equipped with an up-to-date version of
Chrome or Firefox, a functioning webcam and microphone, and a stable internet connection.
9.2 In the event of technical faults caused by Expert Tutoring or the Tutor, the lost instructional time shall be:

• Made up within the current Session (if feasible),

• Rescheduled to another time,

9.3 Expert Tutoring shall investigate all concerns raised regarding Session quality and shall, if warranted, offer an alternate Tutor or full refund if a suitable replacement cannot be arranged.

10. Intellectual Property
10.1 All instructional materials, worksheets, and content provided by Expert Tutoring remain the sole and exclusive intellectual property of Expert Tutoring.
10.2 Clients and Students shall not copy, distribute, reproduce, or use such materials for any purpose
other than personal academic use without the express written consent of Expert Tutoring.

11. Limitation of Liability
11.1 Expert Tutoring, including its Tutors and staff, shall not be liable for any direct, indirect, incidental, or consequential damages arising from the provision or use of Services.
11.2 Expert Tutoring is not liable for errors in Student-submitted materials or dissatisfaction with
academic results unless the Services rendered were demonstrably below an acceptable professional standard.

12. Amendments to Terms
12.1 Expert Tutoring reserves the right to amend these Terms at any time.
12.2 Clients shall be notified of any material changes, and continued use of Services shall constitute
acceptance of the revised Terms.
